Acuity v. M/I Homes of Chicago, LLC is among the most important Illinois insurance coverage decisions of the last 25 years. Overturning 30 years of Illinois Appellate Court precedent, including cases too numerous list, the court held that damage to property other than the building being constructed is not necessary to constitute an "occurrence" under a CGL policy.

In order to address this momentous decision the IDC has arranged for two panels. The first panel will discuss the reasoning of the decision from both the insurer and policyholder perspective, including the issues the court left open to be resolved on remand. The second panel will discuss the practical implications of the decision on the construction industry in particular focusing on risk transfer issues.

David H. Anderson is a partner with Anderson Coverage Group LLC where he represents policyholders in insurance coverage disputes. He has a wide-ranging practice involving counseling, mediation, arbitration, and litigation in state and federal courts throughout the United States. David regularly represents policyholders in coverage matters involving construction, directors’ & officers’ liability, professional errors & omissions, first-party property and business interruption, insurance brokers’ errors & omissions, environmental, products liability, and employment practices liability matters. David also counsels clients regarding insurance renewals, policy wording, notice issues, risk management issues, and the drafting of insurance requirements and indemnity clauses in client contracts.

David has significant prior insurance industry experience, having previously worked as a primary commercial underwriter and casualty facultative reinsurance underwriter. He holds the Chartered Property Casualty Underwriter (CPCU) and Associate in Risk Management (ARM) professional designations. David is a frequent writer and speaker on insurance coverage-related issues. In 2014, David was elected as a Fellow to the American College of Coverage Counsel.


Amy Frantz is a Partner at Freeman Mathis & Gary's Chicago office and is a Vice-Chair of the firm’s Midwest Coverage practice team. She practices in the areas of insurance coverage and civil litigation. Amy advises and represents insurers in a variety of third-party and first-party insurance coverage matters arising under commercial general liability, professional liability, auto, property, and umbrella policies. Amy assists clients throughout the life of their claims, including evaluating coverage and risk transfer issues, preparing coverage analyses, drafting reservation of rights and coverage position letters, and litigating declaratory judgment actions. She also defends clients in a variety of civil litigation matters including construction accidents and defects, premises liability, and transportation negligence, in state and federal jurisdictions throughout Illinois.


Michael Hallock is the Managing Partner of the Chicago office of McCoy Leavitt Laskey LLC. McCoy Leavitt Laskey is the nation’s premier catastrophic fire and explosion law firm. McCoy Leavitt Laskey represents corporations and insurers in liability and subrogation in all 50 states. A former federal prosecutor, Mike has prevailed in high-profile trials, and appeals before the 5th and 7th Circuit Courts of Appeals. Mike is published in the areas of transportation and fire and explosion and is the honored recipient of numerous awards including, the Distinguished Public Service Award, and the Secretary of Transportation’s Award.


William K. McVisk is a partner at the firm of Tressler LLP in Chicago, where he focuses his practice on complex insurance coverage litigation and medical liability. He has handled all areas of coverage and bad faith litigation, with an emphasis on third-party bad faith and coverage. He is a fellow of the American College of Coverage Counsel, past President of the Illinois Association of Defense Counsel, and Illinois State Representative for DRI. Bill has given numerous presentations on insurance coverage issues to various organizations, including IDC, DRI, CLM and PLRB.

Bradley J. Smith of Keefe, Campbell, Biery & Associates, LLC in Chicago where he manages the firm’s civil litigation and trial practice. He handles a variety of defense cases including, employment law, general liability, products liability, and other similar tort areas of the law. He also routinely advises his clients on general liability and employment law issues.

Aleen Tiffany is a Partner in the Chicago office of HeplerBroom, LLC. An experienced trial attorney, she has successfully litigated and overseen a wide variety of matters nationwide. Her experience includes all aspects of the commercial construction industry, with a primary focus on commercial contracts, bodily injury defense, construction defect, and risk management and transfer. She has served as outside general counsel for a large multi-state commercial construction company and as National Coordinating and Oversight Counsel for general liability claims for subsidiaries of a Fortune 500 company.

Ms. Tiffany is a Certified Construction Risk and Insurance Specialist through the International Risk Management Institute. She is also an approved arbitrator Panelist with the American Arbitration Association, serving both the Construction and Commercial/Insurance panels; additionally, she was trained and approved as part of the late 1990s Mandatory Court-annexed Arbitration programs in Illinois’ 19th and 22nd Judicial Circuit.
