Construction Worker Injuries: Responding to the Risk

The program, presented by the IDC and the Society of Illinois Construction Attorneys (SOICA) is targeted to attorneys who defend construction worker accident claims and attorneys who negotiate and draft construction contract safety provisions. Attendees will learn about the law of negligence applied to construction worker accident claims and how to draft construction contract safety provisions.

Outline General Rule & Restatement 414 Exception Regarding Contractor's Liability
Presented by: Aleen Tiffany and Holly Whitlock-Glave, HeplerBroom LLC and Hillary Weigle, SmithAmundsen, LLC

 In this presentation, our featured speakers will cover the General Rule and its Exception, Restatement 414. The speakers will discuss the Restatement; the types of control identified by courts when assessing duty; and, vicarious v. direct liability under Restatement 414. Finally, the speakers will offer practice pointers and take-aways important to defending construction litigation.

Panel Discussion: Counseling Contractor Clients to Minimize Liability for Jobsite Injuries
Panelists: Patrick Donnelly, Donnelly Lipinski & Harris LLC; Robert J. Franco, Franco Moroney LLC, and Daniel Rosenberg, McHugh Construction

Our panelists will offer guidelines for drafting construction contracts to minimize liability through contract language and guidelines for contractors' actions onsite for minimizing liability through actions onsite. Panelists will offer suggestions for contract terms and language as well as do's and don'ts of contractor onsite actions.

Featured Speakers

Patrick G. Donnelly practices with Donnelly & Harris, LLC, with offices in Chicago and Mokena. In thirty years of defense trial practice, he has represented subcontractors, general contractors, owners and regulated utilities in personal injury and construction defect cases. He is a founding member of the Society of Illinois Construction Attorneys, from the time it had five members, in June, 2002. He is a graduate of Marquette University and De Paul College of Law.
Robert J. Franco is partner at Franco Moroney LLC in Chicago where he focuses his practice on complex litigation including professional liability/errors and omissions, appeals, extraordinary remedies, construction and insurance litigation. Mr. Franco’s litigation experience involves some of the largest litigations in the United States, including the Chicago Flood and the FDIC litigation. His trial experience includes felonies and misdemeanors, high value tort defense, property damage, and commercial litigation. He has extensive experience in trying administrative disputes, and has arbitrated cases under private arbitration rules, the American Arbitration Association, the International Chamber of Commerce, the Cairo Regional Centre for International Commercial Arbitration, and UNCITRAL.

Daniel Rosenberg is General Counsel and Vice President at James McHugh Construction Company. Formerly a partner at Sheppard Mullin Richter & Hampton, LLP, Mr. Rosenberg was named one of the “Leading Construction Lawyers” by Chambers USA and was elected to the Society of Illinois Construction Attorneys (SOICA). He is recognized as a top Illinois lawyer in construction law by the Leading Lawyers Network and is a member of the Construction Owners Association of America. A 1998 graduate of Miami (Oh.) University, he earned his law degree from Loyola University of Chicago.2:30

Aleen Tiffany, partner at HeplerBroom LLC in Crystal Lake focuses her practice on complex civil litigation and corporate construction matters, including: Construction injury and defect litigation; Construction contract and risk transfer; Complex civil and commercial litigation; Commercial general liability coverage and risk transfer focus; and, Mechanics’ Lien and Surety Bond claims and litigation. An experienced trial attorney, she has successfully litigated and overseen a wide variety of matters nationwide. Her experience includes all aspects of the commercial construction industry, with a primary focus on commercial contracts, bodily injury defense, construction defect, and risk management and transfer. She serves as outside general counsel for a large multi-state commercial construction company and as National Coordinating and Oversight Counsel for general liability claims for subsidiaries of a Fortune 500 company. Ms. Tiffany is also a trained and approved arbitrator in the 19th and 22nd Judicial Circuit Mandatory Court-annexed Arbitration programs.
Hillary Weigle, partner at SmithAmundsen, LLC in Chicago focuses her practice on construction and real estate. She counsels clients on issues relating to construction, catastrophic loss, premises liability and products liability and regularly represents contractors and subcontractors in personal injury claims. Hillary has served as lead counsel in 16 jury trials. Her experience includes extensive work in personal injury, a case involving the wrongful death of a minor child and obtaining a defense verdict in an admitted liability matter where the plaintiff sought more than $1 million in damages. In addition to her trial experience, Hillary also prepares and conducts all facets of multiple arbitrations and mediations as lead counsel in matters involving construction, catastrophic loss, premises liability, employment, products liability and personal injury.

Holly C. Whitlock-Glave is a senior associate at HeplerBroom, LLC in Crystal Lake, Illinois. She primarily focuses her practice in the defense of complex, multi-party commercial construction litigation involving construction injury, construction defects, risk transfer, construction contract, risk management, general liability coverage issues, expert analysis & investigations and settlement negotiations/alternative dispute resolution. She earned her B.A. cum laude from Augustana College and earned her juris doctorate cum laude from Northern Illinois University Law School. She has been admitted to practice in the State of Illinois and U.S. District Court, Northern District of Illinois. Ms. Whitlock-Glave is a long standing member of the Illinois Association of Defense Trial Counsel (IDC) and Chair of the IDC Construction Law Committee.
